Insurance: Participant's personal insurance is not provided by SportUP. SportUP only provides Public Liability Insurance. If participants wish to be insured, they are advised to arrange their own personal injury insurance to cover them participating in our leagues/classes/events. Photos/video: Participants in our sports leagues and fitness classes permit SportUP, without consideration or compensation to the participant, to photograph and video participants at our events, for purposes including but not limited to, publication in both offline and online media channels. 1. Refunds 1.1. All new individual players are granted a 24hr refund period, whereby members may cancel their membership within 24hrs of their first game time to receive a full refund. Team entries are excluded from refunds. 1.2. Upon request of cancellation, their membership will be terminated with immediate effect. 1.3 No refunds are provided for bookings cancelled after this 24hr period regardless of cause for refund. 2. Failed payments 2.1 After a failed payment you are removed from the team until the monthly instalment is paid. 2.1. If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The cost of this instruction will be borne by you, including costs in tracing you should you have changed address. 3. Missed Games 3.1. As memberships are broken down into monthly payments, SportUP will not compensate members who do not show up to sessions they have paid for. To enter a membership agreement with SportUP, you accept the above Terms & Conditions. Waiver: By entering and participating in the leagues/classes you accept the following Waiver, Release of Liability, Assumption of Risk and Indemnity Agreement: In consideration of me being allowed to participate in any way in the upcoming league/class and associated social events provided and hosted by SportUP, inclusive (the "Activities"), I hereby acknowledge and agree as follows: 1. I understand the nature of the Activities and acknowledge my experience and capabilities and believe I am qualified to participate in the Activities. I further acknowledge that I am aware that the Activities will be conducted in facilities open to the public during the Activities. I further agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the Activities. 2. I fully understand that: (a) the Activities involve risks and dangers of serious bodily injury, including permanent disability, blindness, paralysis and death ("Risks"); (b) these Risks may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place or the negligence of the Releasees (defined below); (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and (d) I fully accept and assume all such risks and all responsibilities for losses, costs, and damages incurred as a result of my participation in the Activities. 3. I hereby release, discharge, covenant not to sue, and agree to hold harmless SportUP, it’s owner(s), administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors and advertisers, and, if applicable, owners and lessors of premises on which the Activities take place (each considered to be one of the "Releasees" herein) from all liability, claims, demands, losses, or damages on account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including rescue operations, and further agree that if, despite this release, I, or anyone on my behalf, makes a claim against any of the Releasees named above. 1. I voluntarily wish to enter and participate in SPORTUP games and EVENTS; 2. I understand that such participation involves arduous and strenuous athletic activities; 3. I am qualified, in good health, physically fit and in proper physical condition to participate in SPORTUP games and such EVENTS; 4. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured; 5. I will obey all rules and regulations for participation in the SPORTUP and the EVENTS or be sanctioned or disqualified from this and all future participation with SPORTUP; 6. I will inspect and examine all conditions with which I am involved and relating to SPORTUP and EVENTS and, if I observe any condition which I consider to be unacceptably hazardous or dangerous, I will notify the proper authority of the SPORTUP and will refuse and refrain from taking part until the condition has been corrected to my satisfaction; 7. I understand that the RELEASEES are not responsible for any inclement weather which may affect the EVENTS and that this Release and Waiver shall encompass all CLAIMS against the RELEASEES arising from or relating to such inclement weather. 8. I consent to evaluation and treatment of injuries/illnesses occurring during my participation in SPortUP events by SportUP staff and its affiliates. I understand First Aid coverage may not be present at all events. I authorize representatives of SportUP and its affiliates to contact me regarding EVENT follow up, SPORTUP activities, and available services. I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, LOSS, LIABILITY, DAMAGES OR COSTS ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. NOTHING IN THESE TERMS AND CONDITIONS SHALL LIMIT OR EXCLUDE THE LIABILITY OF THE RELEASEES FOR ANY DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE. THESE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH AUSTRALIAN LAW AND ALL PARTIES SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE AUSTRALIAN COURTS.
